Permit Renewal Information

Information on Dunn Landfill’s permit renewal status will be available on this page. Click on the links below to view the current permit renewal application on file with the New York State Department of Environmental Conservation. Documents are also available to teach members of the public how to provide testimony on the landfill’s impacts on their livelihood as well as health.

On January 28, 2022, NYS DEC sent a notification of incomplete application to the applicant. Before the process can move forward, the applicant must address the requests outlined in the returned letter from the Division of Permits. Short Description: Permit renewal and modification to construct MSE berm
Project Description: NYSDEC has reviewed permit application documents that were submitted for a Mined Land Reclamation permit renewal and modification as well as permit application documents submitted for a Solid Waste Management Facility permit renewal and modification for the Dunn Mine and C&D Facility. Renewal of the Mined Land Reclamation and Solid Waste Management permit applications would provide for continuation of ongoing activities which include sand and gravel mining operations and concurrent disposal of construction and demolition (C&D) material. The proposed modifications to the existing permits are limited to the construction of a mechanically stabilized earthen berm (“berm”) along the northern boundary of the property. The proposed construction of the berm is intended to mitigate impacts from the facility on the Rensselaer City K-12 school which is located on the adjacent property.

Pursuant to the requirements of Section 7(3) of the Climate Leadership and Community Protection Act (Climate Act), Chapter 106 of the Laws of 2019, NYSDEC has requested and received information regarding the facility’s consistency with the Climate Act. The NYSDEC and other agencies must ensure that administrative decisions, including issuance of permits, do not disproportionately burden Disadvantaged Communities. This facility is located within, and has the potential to impact, a Disadvantaged Community, and therefore was required to submit a CLCPA Analysis for the pending permit application. While the applicant asserts that renewal and modification of the proposed permits would not disproportionately burden the Disadvantaged Community, NYSDEC has not yet made a final determination. Prior to issuing any permits for the facility, NYSDEC is required to ensure compliance with the requirements of Climate Act Section 7(3).

While NYSDEC is providing opportunities for the public to comment on the pending applications, NYSDEC has not made any final determinations on the pending applications for the facility. Prior to issuing any final permits for the facility, NYSDEC would need to ensure that the project can meet the requirements of both Section 7(2) and Section 7(3) of the Climate Act. NYSDEC has yet to make either determination. NYSDEC may seek additional information from the Applicant to facilitate making these legally required determinations.
